1. Payment
A $100 retainer is required to secure a portrait sessions and will be invoiced to the email address the Client has provided above and is due within 24 hrs to hold the session time and date. In the event of cancellation by the Client the retainer paid is non-refundable, it shall be liquidated for damages to the Photographer in the event of a cancellation, or breach of contract by the Client. No date is reserved until a retainer is received. The retainer shall be applied towards the total cost of the service to be rendered. The balance of the complete package price must be paid before or on the day of session. If final payment is not received, the Photographer will not be expected to complete services for the session.
2. Reschedules
Sessions are based on permitting weather and the general health of all parties. Both parties agree that in the event of illness, 24 hour notice must be given in order to reschedule the session within the time frame available. If the party is unable to make the session in the timeframe provided the spot may be sold to an outside party. In the event of inclement weather or Act of God that poses threat to the general well being or equipment used the session will be rescheduled for a back up date or retainer be refunded.
3. Re-shoots
There are no re-shoots for destination sessions.
4. Copyright
It is illegal to copy, scan, reproduce, or post online in forums or elsewhere without the written permission of the Photographer. Violators of this federal law will be subject to its civil and criminal penalties. The Photographer retains the copyright to all images produced by the Photographer and may use the images in any manner including professional samples, displays, internet websites, advertising, exhibitions, and contests. If downloading High Resolution images from their gallery, Clients will be given a written release to make personal copies of images from their digital files upon request. The client understands the digital images given cannot be used for profit or self-advertising and all posting of images on the Internet must contain the Photographer's watermark and be acknowledged as images by the Photographer. Client also understands that after obtaining a written release, publishing photos on websites, i.e. personal website, Facebook, etc., client will not edit the photos in any way, i.e. editing the watermark, cropping, filters, etc.
5. Online Galleries
The online gallery provided by the Photographer to the Client is of handpicked and artistically edited images only and will be emailed to the address the Client has noted in their contract. Original and unedited photographs are not included. Photographer retains the right to edit the chosen photographs and omit any images not deemed creditable as professional in quality or within the photographer’s artistic standards. Client agrees to abide by Photographer’s editing decisions. Professional quality prints and products are available to the client via the online gallery emailed to the client. The Client does retain a print release to purchase prints from any lab of their choosing but understands that in the event that the Client purchases images and products from commercial and consumer labs the Photographer will not be held accountable for the image print or product quality produced by any lab not recommended.
6. Session Etiquette
Please arrive on time for your appointment, beach sessions are very time specific. If outfit changes need to be made prior to the scheduled appointment time then the Client agrees to arrive early in order to be ready when the session begins. If the Client or other parties being photographed will be arriving more than 10 minutes past the scheduled session start time, the Photographer must be notified and it is at the discretion of the Photographer to continue the session, deduct time from the session, or to cancel the session. Tardiness of 20 minutes or greater for Sunrise or Sunset sessions will result in a reschedule or cancellation without refund. The Client agrees to put away all cameras, cell phones, video, and game devices during the session to prevent the distraction of subjects being photographed.
7. Location
The location of these sessions is South Jacksonville beach/North Ponte Vedra beach. I will have an Airbnb for parking and will send the address in confirmation emails a few days before I arrive.
