Newborn Session

This Portrait Session agreement is between Erin Rose Photography, hereinafter referred to as Photographer, and the Client(s) detailed in the form below and is a legally binding agreement between both parties. If either party would like to change this agreement it must be done in writing and signed by both parties prior to the session date.

1. Payment
A $50 retainer is required to secure all individual sessions or $100 for bundle packages and will be invoiced to the email address the Client has provided above and is due within 24 hrs to hold the session time and dates. If selecting Magnolia Plantation the $150 location upgrade is also due with the retainer to reserve a spot in the Plantation Schedule. In the event of cancellation by the Client the retainer(s) paid is non-refundable, it shall be liquidated for damages to the Photographer in the event of a cancellation, or breach of contract by the Client. No dates are reserved until a deposit is received. The deposit shall be applied towards the total cost of the service to be rendered. The balance of the complete package price plus tax must be paid before or on the day of session. If final payment is not received, the Photographer will not be expected to complete services for the session.

2. Reschedules
Sessions are based on permitting weather and the general health of all parties. Both parties agree that in the event of illness, 24 hour notice must be given in order to reschedule the session without loss of the retainer. Arrangements must be initiated by the client to reschedule within 2 weeks from the original session date, if 2 weeks pass without communication the client shall lose the retainer and will need to begin booking process again. In the event of inclement weather or Act of God that poses threat to the general well being or equipment used the session will be rescheduled for a different time or a later date with no penalty to the client. 

3. Re-shoots
Client shall assist and cooperate with Photographer in obtaining desired photographs. Photographer shall not be responsible for photographs not taken as a result of children or Client’s failure to provide reasonable assistance or cooperation. Client will be respectful to Photographer and all parties being photographed. Photographer has the right to end the session, without refund, if there is lack of cooperation or respect. A re-shoot shall be offered at the Photographer's discretion if desired photographs were not obtained for circumstances beyond both parties' control. Client understands that cell phones and video recording devices are not permitted to be used during sessions. 

4. Copyright
It is illegal to copy, scan, reproduce, or post online in forums or elsewhere without the written permission of the Photographer. Violators of this federal law will be subject to its civil and criminal penalties. The Photographer retains the copyright to all images produced by the Photographer and/or the Photographer's subcontractors and may use the images in any manner including professional samples, displays, internet websites, advertising, exhibitions, contests, licensing to third parties, and any other purpose in any medium. If downloading High Resolution images from their gallery, Clients will be given a written release to make personal copies of images from their digital files upon request. The client understands the digital images given cannot be used for profit or advertising and all posting of images on the Internet must contain the Photographer's watermark and be acknowledged as images by the Photographer. Client also understands that after obtaining a written release, publishing photos on websites, i.e. personal website, Facebook, etc., client will not edit the photos in any way, i.e. editing the watermark, cropping, filters, etc.

5. Online Galleries
The online gallery provided by the Photographer to the Client  is of handpicked and artistically edited images only and will be emailed to the address the Client has noted in their contract. Original and unedited photographs are not included. Photographer retains the right to edit the chosen photographs and omit any images not deemed creditable as professional in quality or within the photographer’s artistic standards. Client agrees to abide by Photographer’s editing decisions. Professional quality prints and products are available to the client via the online gallery emailed to the client. The Client does retain a print release to purchase prints from any lab of their choosing but understands that in the event that the Client purchases images and products from commercial and consumer labs the Photographer will not be held accountable for the image print or product quality produced by any lab not recommended.

6. Communication
Client understands and agrees to maintain communication with Photographer throughout the pregnancy including important medical updates, restrictions of mom or baby, and contact must be made within 4 hours of delivery for scheduled Fresh 48 Hospital sessions and within 24 of delivery for newborn sessions. Fresh 48 Hospital Sessions will only take place during daylight and visitation hours as set forth by the Hospital. If the Photographer is NOT available within daylight hours prior to hospital discharge a backup photographer will be sent to capture the Fresh 48 Session or the Client will be refunded the Fresh 48 payment. Newborn Sessions must be scheduled upon your discharge from the hospital at a date that works within the Client and Photographer's schedules and during optimal daylight hours.
