1. Payment
A $100 deposit is required to secure all portrait sessions and will be invoiced to the email address the Client has provided above with the remaining balance due on the day of the session. In the event of cancellation by the Client with less than 48 hour notice of scheduled session, the amount paid is non-refundable. In the event of the Client cancellation the Client may sell their appointment spot to someone else with the Photographer's approval. Otherwise, the payment made shall be liquidated for damages to the Photographer in the event of a cancellation, or breach of contract by the Client. The balance of the complete package price must be paid by the completion of the portrait session. If final payment is not received, the Photographer will not be expected to complete services for the client.
2. Reschedules
No Reschedules or Reshoots will be made for this event unless due to unfavorable weather. The Photographer will try everything in her power to capture the best possible quality images but shall not be responsible for photographs not taken as a result of Client’s failure to provide reasonable assistance or cooperation. Client will be respectful to Photographer and all parties being photographed. Photographer has the right to end the session, without refund, if there is lack of cooperation or respect.
3. Copyright
It is illegal to copy, scan, reproduce, or post online in forums or elsewhere without the written permission of the Photographer. Violators of this federal law will be subject to its civil and criminal penalties. The Photographer retains the copyright to all images produced by the Photographer and/or the Photographer's subcontractors and may use the images in any manner including professional samples, displays, internet websites, advertising, exhibitions, contests, licensing to third parties, and any other purpose in any medium. When receiving High Resolution images in their gallery, Clients will be given a written release upon request to make personal copies of images from their digital files. The client understands the digital images given cannot be used for profit or advertising and all posting of images on the Internet must contain the Photographer's watermark and be acknowledged as images by the Photographer. Client also understands that after obtaining a written release, publishing photos on websites, i.e. personal website, Facebook, etc., client will not edit the photos in any way, i.e. editing the watermark, cropping, filters, etc.
4. Galleries
The online gallery provided by the Photographer is of handpicked and artistically edited images only and will be emailed to the address the Client has noted in their contract. Original or RAW photographs are not included. Photographer retains the right to edit the chosen photographs and omit any images not deemed creditable as professional in quality or within the photographer’s artistic standards. Client agrees to abide by Photographer’s editing decisions. The Client understands that in the event that the Client prints images at an outside print vendor, The Photographer will not be held accountable for the image print or product quality produced by any other lab.
5. Session Etiquette
Please arrive ON TIME and ready for your appointment, since there are others scheduled after you. If outfit changes need to be made prior to the scheduled appointment time then the Client agrees to arrive early in order to be ready when the session begins. Changing tent for clients will be provided. If the Client or other parties being photographed will be arriving more than 5 minutes past the scheduled session start time, the Photographer must be notified and it is at the discretion of the Photographer to continue the session, deduct time from the session, or to move the session time. **The Client agrees to put away all cameras, cell phones, video, and game devices during the session to prevent the distraction of subjects being photographed.** The Photographer reserves the right to end the session if a cell phone is present and being used during the session in any way. (Please leave it in the car!)
6. Pets
Well-mannered, friendly, and LEASHED dogs are allowed on the Lebanon Christmas Tree Farm for this family portrait session. As the pet owner you shall accept full liability for any incidents that occur between your pet and any other party. Please be courteous and responsible; be ready to clean up after your dog in the likely event that they decide to go.
